Subject:- Medical facilities for in-patient treatment and post-operative follow-up treatment to ECHS beneficiaries residing in districts not covered by ECHS.

Sir.

1, The undersigned is directed to invite attention to Govt. of India, Ministry of Defence letter No. 24(48)/03/US(WE)D(Res) dated 19th December, 2003 and to state that keeping in view, the difficulties being faced by the ECHS beneficiaries residing in districts not covered by ECHS it has now been decided to liberalise the ECHS Rules as follows to enable them to avail medical facilities for in-patient treatment and post- operative follow-up treatment-

(a) (i)   ECHS beneficiaries who are holding a valid ECHS Card and are residing in districts not covered by ECHS shall be eligible to obtain treatment from Govt. (Central/State/Local Self Government) hospitals and submit the medical re-imbursement claim to the ECHS Polyclinic (i.e. they can avail the treatment without obtaining referral from Polyclinic located outside their district),

(ii) Re-imbursement shall be limited to the CGHS rates applicable to the nearest ECHS Polyclinic and as per the ceiling rates and ward entitlements or as per actuals whichever is lower.

(b) (i)  ECHS beneficiaries who are holding a valid ECHS card and are residing in districts not covered by ECHS shall be eligible to obtain post¬operative follow-up treatment from Govt. (Central/State/Local Self Government) hospitals in follow up cases of Renal Transplant Surgery Knee and Hip Joint Replacement, Cancer Treatment Neuro Surgery and Cardiac Surgery. However, prior permission (referral) is to be obtained from the OIC of nearest ECHS Polyclinic.

(ii) Permission shall be issued for 3 to 6 months at a time and may be extended based on medicalrequirement. Reimbursement for consultation, procedures and investigations shall be limited to CGHS rates applicable to the nearest ECHS polyclinic and as per the ceiling rates and ward entitlements or as per actuals ,whichever may be lower. OPD medicines shall be obtained from the concerned Polyclinic for a maximum period of 3 months at a time.

2. These order will come into effect from date of issue.

3. This issues with the concurrence of MoD (Finance) vide U.O. 1574/13/Fin/Pen dated 11th July, 2013.

Complaints against CGHS & Govt initiatives to improve the services

The Central Government Health Scheme (CGHS) is providing comprehensive healthcare facilities to the Central Government employees and pensioners and some other select categories of persons in 25 cities across the country. Government has taken a large number of initiatives over last few years to improve the functioning of CGHS which have yielded positive results. However, the Ministry has also been receiving suggestions, representations and complaints on various aspects of the functioning of this Scheme. The complaints reported from different States are generally of similar nature and can be broadly classified in the following categories:

1. The number of private hospitals on the panel of CGHS in some cities including Thiruvanathpuram, Kerala, is not adequate. 

2. The number of CGHS dispensaries is not adequate. 

3. Need to cover more cities under CGHS.

4. Shortage of doctors and staff in dispensaries.

5. Impolite and rude behavior of dispensary staff.

6. Delay in supply of indented medicines.

7. Overcharging and denial of credit facility by empanelled private hospitals.

8. Disruption in services due to break down in internet connectivity. 

9. Delay in settlement of Medical Reimbursement Claims. 

10. Delay in issue of plastic cards. 

11. Non- supply of Ayurvedic medicines, etc.

Government has taken the following initiatives to improve the services of CGHS to its beneficiaries:

1. ‘Continuous Empanelment Scheme’ has been revived in all CGHS locations to empanel more number of eligible private hospitals and diagnostic/ imaging centres. The process of empanelment has also been decentralised by delegating powers at the city level.

2. CGHS beneficiaries residing in non-CGHS areas have been allowed to avail follow up and inpatientmedical treatment in hospitals recognised under CS (MA) Rules and ECHS. 

3. Ministry has mooted a proposal for opening at least one dispensary in the capital of the States where CGHS is not in operation.

4. CGHS engages retired Government doctors on short term contract basis to address the shortage of doctors wherever required. The powers to engage retired doctors on contract basis have also been delegated at city level.

5. Instructions have been issued to the doctors and other staff to be polite and courteous in their behaviour towards the beneficiaries. 

6. There is a provision to penalise the authorised local chemists for delay in supply of indented medicines.

7. Appropriate actions are taken against the defaulting hospitals for overcharging and denial of credit facility.

8. Instructions have been issued to provide consultation/treatment even in case of breakdown of internet connectivity. Instructions have also been issued to create standby arrangement to ensure uninterrupted services.

9. Continuous monitoring of MRCs are done at the level of Additional Directors to ensure timely settlement. Time limit of 45 days has been fixed for final settlement of MRCs.

10.  The requirement for referral /permission for diagnostic tests/investigations has been done away with.

11.  ‘SMS-Alert’ system has been introduced by CGHS for close contact with CGHS beneficiaries 

12.  CGHS beneficiaries can avail medical consultation and medicines from any CGHS Wellness Centres across the country.

13.  Biometric System for recording attendance has been introduced in CGHS to ensure punctuality.

This below information was given by the Union Minister of Health & Family Welfare ShriGhulamNabi Azadin written reply to a question in the LokSabha yesterday.

This Ministry has been receiving complaints/grievances in respect of the following major aspects.

 1.Administrative:- Misbehavior by medical and paramedical staff, Shortage of staff,  Punctuality etc.

2. Technical:- Delay in settlement of medical reimbursement claims (MRCs),  Supply of substitute medicines instead of the prescribed by the Govt. specialists, Delay in supply of indented medicines, etc.

3. Related to empanelled hospitals: Denial of credit facility, Misbehavior of hospital doctors/staff, overcharging, etc.

4. Related to Internet accessibility: Disruption in services due to breakdown in internet connectivity,  etc.

To redress the grievances/complaints, the following steps have been taken:

Administrative :-Instructions have been issued to the doctors /para-medical staff working in CGHS to be polite and courteous in their behaviour with the patients. In specific cases transfers have also been made and disciplinary actions initiated. Contractual doctors are appointed to meet the requirement of Medical Officers. Regular inspections are carried out. 

Technical:-The time limit for clearance of MRC bills has been fixed. CGHS doctors are advised to prescribe generic medicines to the maximum extent. The indented medicines are supplied through various local chemists to avoid the delay.

Related to empanelled hospitals: Penalty is imposed and suitable action is initiated against the erring empanelled private hospitals.

Related to Internet accessibility: -Medical Officers have been instructed not to stop to provide the consultation/treatment in case of failure of internet connection.

Apart from the above, SMS Alert system has been introduced aiming at bringing transparency in delivery of services as major initiative. Redressal Committees have also been formed by CGHS.

The allocation of financial resources is based on the evaluation of specific requirements/demands projected by the CGHS units and availability of resources.

Treatment from CGHS Empanelled Hospitals 

As per the existing guidelines, a CGHS beneficiary is required to obtain permission from his administrative Department / Office or CMO in charge (in case of pensioner beneficiary) to avail medical treatment in a CGHS empanelled private hospital. However, in case of emergency he can go to any hospital whether empanelled or not, to avail medical treatment. This provision is necessary to ensure proper medical treatment of a CGHS beneficiary in consultation with the Government specialists. This is also a measure of ‘checks and balances’ to ensure financial propriety and optimum utilization of public money. 

This Ministry has been receiving representations from the individuals; Pensioners Associations etc. to allow the CGHS beneficiaries to take treatment from the CGHS empanelled private hospitals without obtaining the requisite permission. However, their requests have not been acceded to as the present referral system is considered necessary in the interest of the beneficiaries and it is also necessary as a check and balance measure to ensure financial propriety. 

CGHS is already providing comprehensive and hassle free healthcare services to its beneficiaries through its large network of Wellness Centres and empanelled private hospitals and diagnostic /imaging centres. With a view to further simplify and liberalize the procedures in CGHS to make its services more hassle free, the requirement of mandatory permission for undertaking diagnostic tests and investigations has been done away with w.e.f. 1st January, 2013. In addition, ‘Continuous Empanelment Scheme’ has also been revived at all CGHS locations to empanel more number of eligible private hospitals to enhance accessibility and availability of medical services to the beneficiaries in a hassle free manner.

(a) to (c): All allopathic dispensaries in the country except the one in Jammu have been computerized. 26 out of 32 AYUSH dispensaries/units in Delhi NCR have been computerized. AYUSH dispensaries / units in outside cities have not been computerized. 19 P & T dispensaries in 12 cities, which have been taken over recently by CGHS w.e.f. 01.08.2013, are also not computerized. The 4 CGHS hospitals (all in Delhi) have also not been computerized. No time frame can be given at this stage.

The reasons for non- computerizations:-

# Allopathic and AYUSH dispensaries outside Delhi NCR and CGHS hospitals were not included when the current computerization process was initiated.

# 6 AYUSH dispensaries in Delhi NCR- two Ayurvedic dispensaries/units at Kidwai Nagar and Gurgaon are under shifting. Computers in two Unani dispensaries/units at Naraina and South Avenue have not become functional for want of pharmacists. Two other units, i.e., Ayurvedic dispensary/unit at R.K. Puram, Sector- 12 and Unani dispensary/unit at Shahdara require some additional infrastructure/work for computerization.

(d) to (f): After computerization, the CGHS dispensaries are web connected and beneficiaries can avail medical consultation and medicines from any CGHS Wellness Centre/Dispensary across the country.

Subject : Clarification regarding admissible non-admissible items under CGHS

With reference to the above mentioned subject the undersigned is directed to draw attention to the Office Memorandum of even number dated 1st October 2012 issued by this Department in compliance of the directions of Hon'ble High Court of Delhi in the case of Shri Kanhiya Singh Vs U01 and others [W.P.(C) 9044/2011] clarifying admissibility / inadmissibility of items of expenditure for claiming reimbursement under CGHS. The same are being reproduced for a wider circulation and information in compliance of Hon'ble High Court's latest direction issued on 16.05.2013 in this case. The requisite clarifications regarding admissible and non- admissible items under CGHS are provided herewith as under:-

a) "CGHS Package Rate" shall mean and include lump sum cost of inpatient treatment / day care / diagnostic procedure for which a CGHS beneficiary has been permitted by the competent authority or for treatment under emergency from the time of admission to the time of discharge including (but not limited to) — (i) Registration charges, (ii) Admission charges, (iii) Accommodation charges including patients diet, (iv) Operation charges, (v) Injection charges, (vi) Dressing charges, (vii) Doctor / consultant visit charges, (viii) ICU / ICCU charges, (ix) Monitoring charges, (x) Transfusion charges, (xi) Anesthesia charges, (xii) Operation theatre charges, (xiii) Procedural charges / surgeon's fee, (xiv) Cost of surgical disposables and all sundries used during hospitalization, (xv) Cost of medicines, (xvi) Related routine and essential investigations, (xvii) Physiotherapy charges etc. (xviii) Nursing care and charges for its services.

b) Cost of Implants / stents / grafts is reimbursable in addition to package rates as per CGHS ceiling rates for Implants / stents / grafts or as per actual, whichever is lower, in case there is no ceiling rate prescribed under CGHS,

c) During In-patient treatment of the CGHS beneficiary, the hospital will not ask the beneficiary or his / her attendant to purchase separately the medicines / sundries / equipment or accessories from outside and will provide the treatment within the package rate, fixed by the CGHS which includes the cost of all the items.

d) In cases of conservative treatment / where there is no CGHS package rate, the above mentioned items are admissible-items wise at CGHS rates or as per AIIMS rates (if there is no CGHS rate) or as per actual (if there is no CGHS / AIIMS rate) available for any item.

e) Package rates envisage up to a maximum duration of indoor treatment as follows:

12 days for Specialized (Super Specialties) treatment;

7 days for other Major Surgeries;

3 days for Laparoscopic surgeries / normal deliveries; and

1 day for day care / Minor (OPD) surgeries.

However, if the beneficiary has to stay in the hospital for his / her recovery for a period more than the period covered in package rate, in exceptional cases, supported by relevant medical records and certified as such by hospital, the additional reimbursement shall be limited to accommodation charges as per entitlement , investigations charges at approved rates, and doctors visit charges (not more than 2 visits per day per visit by specialists / consultants) and cost of medicines for additional stay).

No additional charge on account of extended period of stay shall be allowed if that extension is due to infection on the consequences of surgical procedure or due to any improper proceed.

f) In addition to the above mentioned items, some patients may require additional facilities/ procedures, which are admissible with proper justification in deserving cases. Therefore, it is not possible to give a comprehensive list of items, which are not admissible.

However, the following items are not admissible:

Telephone charges
Toiletries
Sanitary napkins
Talcum powder
Mouth fresheners

2. It has also been decided to clarify that expenses incurred on medicines, consumables, sundry equipments and accessories etc., which are purchased from outside, based on specific authorization of treating doctor / staff of the concerned hospital will be reimbursable if they are not falling under the list of non-admissible items. In case the empanelled hospital has asked a CGHS beneficiary for purchase of the said items over and above the package rates, reimbursement shall be made to the beneficiary and the amount shall be recovered from the pending bills of hospital.

3.  This Office Memorandum is issued in compliance of the directions of Hon'ble High Court of Delhi in W.P. (C) 9044/2011 [Sh. Kanhiya Singh Vs UOI and others].

The hospitals (including dental clinics and eye centres), diagnostic laboratories and Imaging Centres, which find their names in the list of hospitals, diagnostic laboratories and Imaging Centres approved for empanelment under CGHS in Delhi & NCR are empanelled for a period of one year from the date of issue of this Office Memorandum or till next new empanelment, whichever is earlier.
